RA 10354 Scope and Penalties - RH Bill now a LAW

PNOY had signed RA 10354 or the Act providing for a National Policy on Responsible Parenthood and Reproductive Health last Dec. 21, 2012

After 13 years in Congress RH bill is now a law that allow full access to reproductive health to all except for minors unless they have written consent from their parents and except on certain cases.


What is RA 10354 - Responsible Parenthood and Reproductive Health Act of 2012?

Republic Act (RA) 10354 would provide woman the choice to determine the number of their children, give teenage protection from unplanned pregnancies and educate citizens about sexual health.

It shall also provide full access to family planning from all accredited public health facilities that shall provide full range of modern family planning methods.

That family planning services shall likewise be extended to private health facilities to paying patients.

Number of Sections: 30

Penalties:

(1) Violation of this act shall be penalized by imprisonment ranging from 1 month to 6 months or a fine of P10,000 to P100,000 or both such fine or imprisonment.

(2) If the offender is public officer, elected or appointed he/she shall also suffer the penalty of suspension not exceeding 1 year or removal and forfeiture of retirement benefits depending on the gravity of offense.

(3) If offender is juridical person, the penalty shall be imposed upon the president or any responsible officer.

(4) If offender is pharmaceutical company, its agent or distributor, their license or permit to operate or conduct business in the Philippines shall perpetually revoked and a fine triple the amount involved.

(5) An offender who is an alien shall, after service of sentence be deported immediately without further proceedings by Bureau of Immigration.

Effectivity: 15 days after its publication in at least two newspapers of general circulation
